This Privacy Policy sets out how Alertamigo Pty Ltd (ACN 666 238 455) (ABN 59 666 238 455) (we, us, our) collect, store, use, and disclose your Personal Information and Location Information in connection with our website located at www.alertamigo.com.au (Our Website) the Alertamigo mobile application (Alertamigo) and the services made available through Alertamigo (Alertamigo Services).

By downloading, installing or using Alertamigo or the Alertamigo Services, you agree to the terms of this Privacy Policy and our Terms and Conditions.

1. Types of Information We Collect

1.1 We may also collect certain technical or usage data automatically through cookies or similar technologies if used within Our Website, Alertamigo or the Alertamigo Services (see Clause 8).

1.2 We collect the following types of information:

(a) Personal Information: Information about you that can reasonably be used to identify you, whether directly or indirectly, including but not limited to:

(i) Full name

(ii) Phone number

(iii) Email address

(iv) Device identifiers

(v) Contact information

(vi) Information you submit when creating your Alertamigo Account

(b) Location Information: Data that identifies or approximates your geographic position, including GPS coordinates, cell tower data, Wi-Fi signals, or location shared by your device through Alertamigo or the Alertamigo Services.

(c) User Information: This includes your username, profile picture, and content posted in Alertamigo.

(d) User Content: All Content that you upload or post using Alertamigo including reports, comments, SOS alerts and any other data, images, video, or audio.

2. How We Collect Information

2.1 We may collect Personal Information and Location Information:

(a) when contact us or make any inquiry via Our Website;

(b) when you create or update your Alertamigo Account;

(c) when you voluntarily submit content or data;

(d) when you opt in to share location data with Nominated Contacts;

(e) when you contact us or submit support requests; and

(f) automatically through your use of Alertamigo (e.g. device information, usage patterns).

2.2 We may also collect information from third-party services you use in connection with Alertamigo, such as your Apple App Store or Google account.

3. Why We Collect Personal Information

3.1 We collect your Personal Information and Location Information for the following purposes:

(a) to respond to your inquires;

(b) to provide and operate Alertamigo and the Alertamigo Services;

(c) to support user safety features (e.g. SOS alerts, contact sharing);

(d) to allow you to post and view User Content;

(e) to process subscriptions and in-app purchases;

(f) to troubleshoot technical issues and provide customer support; and

(g) to comply with legal and regulatory obligations.

3.2 If you do not provide your Personal Information and/or Location Information, we may not be able to provide you with access to Alertamigo or all of the Alertamigo Services.

4. Disclosure of Personal Information

4.1 We may disclose your Personal Information and/or Location Information:

(a) to your Nominated Contacts (when you use location sharing or SOS features);

(b) to our service providers (e.g. IT, analytics, support and communication providers);

(c) to law enforcement or emergency services if we are legally required or permitted to do so, including where there is a serious risk to life, health or safety enforcement or regulators as required or authorised by law; and

(d) to third-party platforms for payment processing (e.g. Apple and Google).

4.2 We may disclose your Personal Information and/or Location Information to recipients outside Australia, including service providers or software platforms located in countries such as the United States, Singapore, or others where our third-party suppliers host their systems or support services. This may include cloud-based support services such as Google Maps, Zendesk, which assists us in managing user support and inquiries. We take reasonable steps to ensure that any overseas recipients handle your Personal Information and/or Location Information in accordance with the Australian Privacy Principles.

5. Data Storage and Security

5.1 We comply with our obligations under the Privacy Act 1988 (Cth), including the Notifiable Data Breaches scheme. If a data breach occurs that is likely to result in serious harm, we will notify affected individuals and the Office of the Australian Information Commissioner (OAIC) as required.

5.2 We store your Personal Information and Location Information on secure servers and implement reasonable technical and organisational measures to protect it from misuse, interference, loss and unauthorised access.

5.3 However, no system is completely secure.  You use Alertamigo and share Personal Information and Location Information at your own risk.

6. Data Retention and Deactivation

6.1 Our legal basis for collecting and using Personal Information and Location Information is your consent and/or our legitimate need to provide Alertamigo and the Alertamigo Services to you.

6.2 We retain Personal Information and Location Information for as long as necessary to operate Alertamigo, to provide the Alertamigo Services and to comply with legal obligations. 

7. Teenage Users and Parental Consent

7.1 We do not knowingly collect or allow the use of Alertamigo by children under 13 years of age.  If you believe a child has used Alertamigo or Alertamigo Services without appropriate consent, please contact us and we will act promptly.

7.2 Teenage Users may use a restricted version of Alertamigo with the consent of Supervising Adult.  We do not knowingly collect Personal Information or Location Information from Users under 13.  If we become aware that a User is under 13, we will suspend or delete the account and associated data.

7.3 Supervising Adults are responsible for managing the sharing preferences and use of Alertamigo by Teenage Users under their supervision.

8. Cookies and Analytics

We may use cookies or similar tracking technologies (such as analytics SDKs) to collect technical information about your use of Alertamigo and the Alertamigo Services.  This may include device identifiers, engagement metrics, crash logs, and diagnostics, used to improve the performance and user experience of Alertamigo.

9. Updates to This Policy

9.1 We may update this Privacy Policy from time to time to reflect changes in the law or our practices.  Updates will be posted on our website. Continued use of Alertamigo after an update indicates your acceptance of the revised policy. 

9.2 This Privacy Policy is governed by the laws of New South Wales, Australia.

10. Definitions

In this Privacy Policy, unless the context requires otherwise:

Alertamigo means the software program known as Alertamigo that is downloaded from the Apple App Store or Google Play Store and installed on a User’s device including its user interface, content delivery systems and underlying technical infrastructure.

Alertamigo Services means the features, tools, and interactions available within or enabled by Alertamigo, including but not limited to location sharing, incident posting, comment threads, and subscriptions.

Content means any data, text, images, video, audio, or other material that is submitted, uploaded, posted, transmitted, or otherwise made available by users through Alertamigo or using the Alertamigo Services.  Content includes, without limitation, reports, comments, messages, alerts, and shared location data.

Location Information means data that identifies or approximates your geographic position, including GPS coordinates, cell tower data, Wi-Fi signals, or location shared by your device through Alertamigo or the Alertamigo Services.

Nominated Contacts means people nominated by you and whose contact details are provided by you.

Personal Information means any information about an individual that can reasonably be used to identify them, whether directly or indirectly. This may include names, email addresses, device identifiers, account details, location information, and any other information defined as personal information under the Privacy Act 1988 (Cth).

Supervising Adult means a parent or legal guardian of a Teenage User.

Teenage User means a User aged between 13 and 17.

User means a user of Alertamigo or the Alertamigo Services.

User Content means all Content uploaded to or posted in Alertamigo by Users and includes Your Content.

User Information includes your username, your profile picture and Your Content.  User Information does not include Location Information or Personal Information.

Your Content means all Content that you upload or post using Alertamigo.

11. Access, Correction and Complaints

11.1 You may request access to the Personal Information we hold about you and request corrections by contacting us at the details below.  We will respond within a reasonable timeframe.

11.2 If you have a complaint about our handling of your Personal Information or Location Information, please contact us.  We will investigate your complaint and respond in accordance with applicable law.
